Acas, has launched new guidance, Handling TUPE Transfers, to help employers deal with TUPE legislation when a business changes hands to a new owner. The guidance follows a study which showed that one in eight workplaces in Britain had gone through some kind of business transfer, with transfers affecting up to two million employees each year and that in 2013, the Acas helpline dealt with around 28,000 calls relating to TUPE. The guidance covers:
– An introduction to TUPE and when TUPE applies;
– Who transfers and which employment rights and liabilities transfer;
– A four step procedure for getting the TUPE process right;
– Employee liability information and due diligence; terms and conditions of employment and TUPE;
– TUPE and terminating employment; and
– Information and consultation requirements.
